Important: These Terms & Conditions (the “Terms”) govern your access to and use of MegaWorksheets.com (the “Site”), owned and operated by MegaWorksheets (“MegaWorksheets,” “we,” “our,” or “us”). By using the Site, creating an account, or purchasing any product, you agree to be bound by these Terms and all policies referenced here (collectively, the “Agreement”). If you do not agree, do not use the Site.

1. Definitions

Account: A user profile you create on the Site.
Digital Products: Downloadable files (e.g., PDFs, ZIPs), including the Ultimate Worksheet Bundle and other worksheet packs.
License: The limited permission granted by us to you to use the Digital Products under Section 8.
Order: A purchase transaction you place on the Site.
Household: A single private residence and the parents/guardians and children living there.

2. Eligibility & Children’s Use

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an Order. Adults may use the Digital Products with/for children. We do not knowingly collect personal data from children without parental consent; see our Privacy Policy.

3. Accounts & Security

3.1. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account.

3.2. You must promptly notify us of any unauthorized use or security breach. We may suspend or terminate access if we suspect fraud, abuse, or violation of these Terms.

4. Product Information; Availability

4.1. We strive to describe and display products accurately. Minor variations (e.g., colors, layout, pagination) may occur.

4.2. We may change, suspend, or discontinue any product or feature at any time.

5. Pricing, Currency & Taxes

5.1. Prices are shown in USD by default unless otherwise stated. Currency conversions (if shown) are approximations; your bank or payment provider determines the final exchange rate and fees.

5.2. Taxes:

Customers with a billing address in Vietnam: prices may be subject to VAT (10%) and will be shown/charged at checkout when applicable.
Customers outside Vietnam: no VAT is charged by us, unless otherwise required by law. Your local tax obligations (e.g., import, use taxes) are your responsibility.

5.3. We reserve the right to correct pricing errors and cancel Orders that rely on incorrect information. If your Order is canceled after payment, we will issue a full refund.

6. Payments & Third‑Party Processors

6.1. We accept various payment methods, which may include PayPal, debit/credit cards, and wallet payments (e.g., Apple Pay, Google Pay) processed via PayPal/our payment partners. Availability depends on your device, browser, and region.

6.2. Payments are processed by third‑party providers. We do not store full card numbers. Your use of a third‑party payment method may be subject to its own terms and privacy policy.

6.3. We may delay or refuse an Order for fraud screening or compliance checks. We are not responsible for delays caused by payment providers.

7. Orders, Contract Formation & Delivery

7.1. Your Order is an offer to purchase. A contract is formed when we send an Order Confirmation to the email address you provide.

7.2. Delivery of Digital Products occurs when download access is made available on the confirmation page and/or via email link. Links may have download limits and/or expiry to prevent abuse.

7.3. You are responsible for ensuring your device(s) can open and use PDF/ZIP files and for keeping backups of your downloads within the permitted license.

8. License to Use Digital Products (Important)

8.1. Personal, non‑commercial license (Household). Upon valid purchase, we grant you a non‑exclusive, non‑transferable, revocable license to download and use the Digital Products for personal, non‑commercial use within your Household.

8.2. Permitted uses:

Print at home or at a local print shop for your Household’s children.
Use on personal devices and tablets (e.g., with a stylus) within your Household.

8.3. Not permitted (strictly prohibited):

Resale, redistribution, sharing, gifting, posting online, or making files publicly accessible (including in groups, forums, drives, or marketplaces).
Using the content in classrooms, schools, tutoring centers, therapy clinics, libraries, co‑ops, or businesses without a separate institutional/commercial license.
Modifying, removing, or obscuring copyright/attribution notices.

8.4. Institutional / Commercial use: Contact us at {{support@domain}} to obtain a separate license.

8.5. We reserve all rights not expressly granted.

9. Right of Withdrawal (EU/UK) & Consent to Immediate Supply

9.1. If you are located in the EU/UK and are a consumer, you generally have a 14‑day right of withdrawal. However, for digital content, this right is lost once download/streaming begins if you have given prior express consent and acknowledgment.

9.2. At checkout, we obtain your express consent to immediate supply of digital content and acknowledgment that you lose the right of withdrawal once downloading starts. If you do not consent, do not complete the purchase.

10. Refunds, Exchanges & Chargebacks

10.1. All Digital Product sales are final once access has been provided, except where required by law or where files are defective and cannot be replaced.

10.2. If you experience technical issues with a file, contact us within 7 days of purchase. We may provide replacement links or updated files.

10.3. Unauthorized chargebacks or payment disputes for valid deliveries may lead to license revocation and Account termination. We may provide evidence (server logs, IP, timestamps) to payment processors.

11. Promotions, Coupons & Gift Cards

11.1. Promotions and coupons are subject to terms stated at the time of offer and may not be combined unless explicitly permitted. We may modify or withdraw offers at any time.

11.2. Gift cards/store credit (if offered) are non‑refundable, non‑redeemable for cash (except as required by law), and subject to expiry dates where permitted.

12. Intellectual Property

12.1. The Site, Digital Products, artwork, text, layout, and all related materials are protected by copyright and other IP laws and are owned by MegaWorksheets or its licensors.

12.2. Trademarks: “MegaWorksheets,” our logos, and product names are trademarks or trade dress of MegaWorksheets. You may not use them without written permission.

13. User Content & Acceptable Use

13.1. If you submit reviews, comments, or other content, you grant us a worldwide, royalty‑free, non‑exclusive license to use, reproduce, and display such content in connection with the Site and our marketing.

13.2. You may not upload or share content that is unlawful, infringing, misleading, defamatory, or harmful to minors, or that contains viruses or malicious code.

13.3. You may not interfere with the Site’s security, attempt to access non‑public areas, or use automated means to scrape or download content.

14. Infringement Notices (DMCA / Copyright Complaints)

If you believe your work has been copied in a way that constitutes infringement, contact: teammegaworksheet@gmail.com with: (a) identification of the copyrighted work; (b) identification of the infringing material; (c) your contact information; (d) a statement of good‑faith belief; and (e) a statement under penalty of perjury that the information is accurate and that you are the rights holder or authorized to act.

15. Software, Devices & Updates

We may update files to fix errors or improve compatibility. You are responsible for ensuring your devices/apps can open standard PDF/ZIP formats. Access to updates for previously purchased products is at our discretion unless otherwise stated.

16. Privacy

Use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data. By using the Site, you consent to our data practices.

17. Disclaimers

17.1. Educational content: We provide learning materials for general educational purposes. Results vary by child; we do not guarantee specific outcomes.

17.2. No professional advice: Our content is not medical, psychological, or therapeutic advice. Consult qualified professionals for concerns about your child’s development.

17.3. As‑is basis: The Site and Digital Products are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, and non‑infringement.

18. Limitation of Liability

To the fullest extent permitted by law, MegaWorksheets and its affiliates, officers, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption, arising from or related to your use of the Site or Digital Products. Our aggregate liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

19. Indemnification

You agree to defend, indemnify, and hold harmless MegaWorksheets, its affiliates, and personnel from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Site or Digital Products, or your violation of law or third‑party rights.

20. Termination

We may suspend or terminate your Account or access at any time for any violation of these Terms or suspected fraud/abuse. Upon termination, your License terminates and you must cease use of Digital Products except for printed copies already made for Household use.

21. Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, government actions, or internet failures.

22. Governing Law; Dispute Resolution

22.1. Governing law: These Terms are governed by the laws of Vietnam, without regard to conflict‑of‑laws rules.

22.2. Venue: Courts located in {{City/Province, Vietnam}} shall have exclusive jurisdiction, except where consumer protection laws of your country provide otherwise.

22.3. Informal resolution: Before filing a claim, you agree to first contact us to attempt good‑faith resolution within 30 days.

23. Changes to the Terms

We may update these Terms at any time. The “Effective date” will be revised accordingly. Material changes will be notified on the Site or by email where appropriate. Your continued use after changes constitutes acceptance.
